USE OF PROPERTY

  1. All units will be used solely as single family residences.
  2. Owners, including their lessees and/or guests, will not permit any nuisance to exist upon their properties so as to be detrimental to any other property or to its owners.
  3. Units will not be used in any trade, business, professional or commercial capacity.
  4. Units will not be subdivided or separated.
  5. Persons under eighteen (18) years of age will not be permitted to use the recreational facilities of the Association unless under the supervision of an adult Sea Oats member the age of eighteen (18) or older except in such cases and under such conditions as the association may from time to time establish.
  6. Parents will be responsible for the actions of their children AT ALL TIMES in and about the Condominiums and Association property.
  7. Guests remaining over 72 hours must be registered with the Association manager.

BUILDINGS

1. The Personal property of all unit owners must be stored within their condominium unit, to include but not limited to lounge chairs, lawn furniture, umbrellas, trash cans, etc. Wet towels and/or laundry will not be hung out to dry.

2. Signs, advertisements, notices or other lettering will not be exhibited, displayed, inscribed, painted or affixed upon any part of the condominium units, buildings or association property.

3. The exteriors of units, including windows, screens, doors and entranceways will not be painted, decorated or modified in any manner without the express approval of the Board of Directors. Brass knockers, house numbers, surnames, etc will not be affixed to the front doors. Screen doors will be installed only in the style approved by the Board of Directors.

4. Windows may be tinted, but not with reflective material, that could reflect into the neighboring unit.

5. Owners are responsible for any damage done to the common areas by any guest or occupant of their home and will be assessed for any repairs.

6. Occupants shall regulate the volume of noise and music to their neighbors' comfort.

7. Television, short-wave and/or hi-fi antennas will not be attached to the buildings, draped on the roofs, or hanging out of the windows.

8. The maintenance engineer is responsible for services in the common areas only. His services will not be requested for personal assistance. Owners, lessees, occupants will not direct, supervise or in any manner attempt to assert control over employees, contractors or employees of contractors while they are working on the properties. All complaints or requests will be made to the property manager.

9. Prior to lengthy departures, in excess of 5 days, unit owners and/or occupants should prepare their unit for summer storms and/or hurricanes. Balconies, terraces, landings, entryways and porches should be free of furniture, plants and other objects , unless the area concerned is protected by hurricane shutters. Removal of items applies to pool/spa patio decks. Unit owners should designate a responsible person or firm to care for the unit should it suffer hurricane damage. The name and number of the caretaker should be on file in the office. Any damage incurred by personal items left in these unprotected areas will be the responsibility of the owner.

10. The association must maintain a key to all units for pest control and emergency use only. Unit owners and/or occupants will not alter the their locks without notifying the association. In any event, upon changing the locks a duplicate key must be given to the manager. Unit keys are coded and kept under lock. Units with security systems must provide the association manager with the code to arm and disarm the system.

11. Trash containers and recycling bins will be stored within the unit except on pickup days. All trash cans must have covers. Plastic bags maybe used for additional trash. No garbage, whether in containers or plastic bags will be left out overnight, as animals will upend the containers and tear open the trash bags. If you have garbage and will not be home for pickup day, please leave the garbage with a neighbor to put out on the appropriate collection day.

PETS

1. Only one (1) household pet shall be kept or harbored in a unit at any time. A household pet shall be a dog, cat, small birds ( myna birds and parrots are not permitted) and tropical fish in tanks. No pet shall weigh more than thirty (30) pounds.

2. A determination by the Board of Directors that an animal or pet kept or harbored in a Unit is a nuisance shall be conclusive and binding on all parties.

3. No pet shall be "tied out' on the exterior of the unit, balcony or patio.

4. No pet shall be permitted outside the unit except on a leash. At no time will pets be allowed to run loose.

5. All pets shall be walked on a leash not to exceed six (6) feet in length.

6. All pet owners will pick up any waste made by their pet.

7. When notice of removal of any pet is given, said pet shall be removed within twenty-four (24) hours of the giving of notice.

POOL RULES

1. PERSONS USING THE POOL, DO SO, AT THEIR OWN RISK.

2. The pool is for the exclusive use of unit owners, approved lessees and their registered guests. Unaccompanied guests will not be allowed use of the pool without a guest pass.

3. No cut-offs or jeans will be worn in the pool; only appropriate bathing attire.

4. Articles such as toys, balls, floats/rafts, etc. are not permitted in the pool except those attached to a bathers body for swimming assistance.

5. Running or ball games are not permitted in the pool or on the pool deck area.

6. DIVING OR JUMPING IN THE POOL IS PROHIBITED.

7. Children under fourteen (14) must be accompanied by adult unit owner, approved lessee or registered guest. Any child entering the pool area without one of these escorts will be asked to leave.

8. Children under five (5) years of age must be accompanied by an adult IN THE POOL.

9. Children not toilet trained or in diapers are not permitted in the pool, without snug fitting plastic pants over the diaper. Bathing suits will be worn over the plastic pants.

10. No wheeled vehicles, including but not limited to bicycles, tricycles, roller blades, skates, skateboards, baby carriages etc., permitted in the pool area.

11. Animals, glass containers, gum are prohibited in the pool area.

12. Electrical appliances, radio, stereos, etc are not permitted in the pool area. Head sets must be used when operating battery operated stereos and radios.

13. Lounges are for the use of all persons using the pool area and may not be reserved. Please sit on towels when using chairs and lounges. Furniture will not be taken from the pool area. Please fold the umbrellas when you are leaving the pool area.

14. No food or drink are allowed IN the pool or within four (4) feet of the POOL. Food and drink may be consumed ONLY AT THE TABLES. Plastic cups, other disposable drinking containers and garbage must be deposited in the trash receptacles, not in the smoking urns.

15. Persons with open cuts/sores, band aids or bandages are not permitted use of the pool.

16. Shower before entering the pool to remove suntan oils and lotions.

17. Use of the sauna is limited to use by persons age eighteen (18) and over. Turn off the sauna and close the door when you are finished using it.

18. Bathing load is limited to 23 persons.

19. Pool is open from dawn to dusk.

TENNIS COURT RULES

1 . Courts are for the sole use of unit owners, approved lessees and their guests. Guests will be accompanied by the unit owner, approved lessee or have a guest pass.

2. Proper attire is required. Shirts and tennis shoes must be worn.

3. Play time is 8:00 a.m. to dark. Keep voices low and to a minimum in the early hours.

4. Limit play time if someone is waiting; reasonably this would be 1-1/2 hours for doubles and 1 hour for singles.

5. Wait for play to stop when entering courts. Do not walk past players while a game is in progress.

6. Jumping over nets is prohibited.

7. Association tournaments and/or scheduled events for unit owners and approved lessees must be scheduled by the POA Manager and take precedence over individual play.

8. No glass, food or drink (other than water), animals, roller-skates, roller blades, skate boards, bicycles, toys, battery operated radios and /or stereos will be allowed on the court surface or within the fenced in court area.

9. Close gates during play and when you depart.

10. Dispose of any trash in proper containers.

11. Do not park in the driveways or block the ingress and egress to any area of any unit. Do not park on grass area.

CLUBHOUSE RULES

1. The clubhouse will be used for Association meetings and social activities. A schedule of these events will be posted monthly.

2. No one is permitted in the clubhouse in a bathing suit or bare feet. A cover up or shirt must be worn over bathing attire.

3. Unit owners and approved lessees may reserve the clubhouse for private non-commercial activities, excluding weekends, i.e., Friday, Saturday, Sunday, and holidays. Reservations can be made through the manager on a first come, first served basis. Association functions and activities have priority over private functions.

4. A $50.00 cleaning fee will be charged for private use of the clubhouse.

5. A deposit check in the amount of $100.00 made out to the Sea Oats POA will be left with the manager as security against damage to the clubhouse and /or furnishings. This deposit will be refunded within 5 business days after the event if no damage is incurred. The 50.00 cleaning fee will be deducted from the deposit.

6. Parking for private events will be limited to the designated parking spaces at the clubhouse or guest parking areas within the community. Any vehicles in violation will be towed at the owners expense.

7. Private parties will be limited to 5 hours, 6 to 11 p.m. Monday through Thursday.

8. Use of the clubhouse will be in compliance with the local fire regulations as posted. Dining 35 and Auditorium 60

SALE OF UNITS

1. All sales of units must be approved by the respective Condominium Association and the Property Owners Association.

2. All prospective buyers will be interviewed prior to the closing of the unit.

3. An application of intent to purchase along with a $50.00 application fee will be sent to the Association along with a copy of the contract and with a "signed witnessed" compliance form, by the prospective buyer.

4. The respective Condominium association will supply a Q&A form for the prospective buyer.

5. The recorded documents will be provided to the purchaser by the unit owner seller. Copies are available from the Condominium Association for $25.00 per set.

6. A Certificate of Approval will be issued by the respective Condominium prior to the closing.

LEASE OF UNITS

1. It is not the intent of these rules to grant the Association a right of approval or disapproval of lessees. It is however the intent to impose an affirmative duty on the dwelling unit owners to keep the property owners association fully advised of any changes in occupancy for the purposes of facilitating the management of the Association's membership records. (Ref: (Article XIII, Declaration of Covenants & Restrictions)

2. No unit will be leased without Condominium & Property Owners Association approval. (A certificate of Approval must be issued prior to the lessees occupancy). (Exhibit A Certificate of Approval)

3. All applications will be reviewed and applicants interviewed, prior to the issuance of a certificate of approval. (Exhibit B Application)

4. The prospective lessee/s will be required to execute a copy of agreement to comply with the rules and regulations of Sea Oats acknowledging that he/she agrees to abide with subject rules and regulations. The Association will retain one signed copy in the unit file, furnish one copy to the lessee and a copy to the unit owner. (Exhibit C Compliance Agreement)

5. In the event any unit owner is delinquent in paying any assessment, and/or the unit owner or his/her family, guests, agents, licensees or invitees are in noncompliance with any provisions of the Declaration of Covenants and Restrictions for Sea Oats, the Association has the right to disapprove of and to void any lease at any time prior to or during the leasehold tenancy until any delinquent assessment is paid and/or any violation of any provisions of said Declaration of Covenants and Restrictions is corrected.

6. A unit owner entering into a lease agreement automatically delegates his right of use and enjoyment of the common area and facilities to his lessee and in so doing, said unit owner relinquishes said rights during the term of the lease agreement.

7. Policy & Procedures:

  A. All unit owners intending to enter into a bona fide lease of their unit shall give notice to the Association together with an application for occupancy; $50 non refundable application fee and a signed agreement from the applicant that they have read and agree to comply with the rules and regulations of the Associations. A deposit of $100.00 will be required by the POA for the issuance of a recreational area key. The deposit will be refunded when the key is returned.

  B. The completed application will be turned over to the interview committee, who will review the application and set up an appointment with the applicants for an interview. A check off list will be prepared which will outline what must be done by the interview committee. (Exhibit D Check list).

  C. The Interview will be conducted by the appointed interviewers who will make sure that the applicants understand and are fully aware of the rules and regulations, and the need for compliance. (Exhibit E Interview Sheet).

  D. Upon completion of the Interview the interview committee will forward the package to the Board of Directors of the respective Associations with a recommendation of approval or disapproval.

  E. The applicant will be notified as quickly as possible of the approval or disapproval.

8. The above policy and procedure has been agreed to and approved by the Board of Directors of all the Associations at Sea Oats.

MEMORANDUM
TO: ALL UNIT OWNERS AND LEGAL OCCUPANTS

SUBJ: POLICY & PROCEDURES FOR THE CONTROL OF VEHICLES AND ENFORCEMENT OF THE PARKING RESTRICTIONS

CANCELLATION: Sea Oats Memo dated 16Mar91 (Procedures to enforce the parking regulations.)

ALL RESIDENTS occupying a unit at Sea Oats are governed by the contents of the Association Documents as specified in reference (a). (Unit owners or approved occupants of the units will park their vehicles in their designated parking area ONLY. The designated parking areas are the garage and the driveway entering your respective garage. All guest parking areas and areas on common roadways ARE NOT for resident parking).

A now policy is being implemented to alleviate the parking problems/violations which have increased over the years.

PARKING REGULATIONS

  A. All vehicles belonging to residents (unit owners & approved lessees) will be registered (using the attached sample form) and identified with a decal placed at the inside left bottom part of the windshield. This will not obstruct your view, and will not contain any identifying logo to indicate where you reside. The information on the form will be placed in your individual unit file and the information will be input into your individual data bank. Changes of vehicles will require a new registration.

  F. Lyons Towing Service has been contracted to handle the towing of unauthorized vehicles in restricted areas. A TOW AWAY warning sign has been installed in accordance with the guidelines set forth in reference (b).

  G. If the Towing Company is notified to Tow Away a Vehicle and the owner or driver of the vehicle arrives on the scene prior to die towing of the vehicle, the owner or driver will be responsible for any charges incurred even through the vehicle is not towed.

6. This Memorandum will be effective thirty days from the date on this letter.
