RULES AND REGULATIONS
- OCCUPANCY
- Units are to be occupied by unit owners, guests or lessees only as a residence and for no other purposes.
- Owners are responsible for guests' and lessees' observance of all rules and regulations and any acts, behavior or damage to common areas caused by guests or lessees.
- Children under the age of 15 years, including unit owner family members, may not occupy a unit without an adult present.
- SECURITY
- All exterior doors of the condominium building and the gates and doors at the pool areas shall be kept closed and locked at all times.
- The Association shall keep a pass-key or keys to all units for emergency use only, as authorized by the Board of Directors. No owner shall alter the unit entrance door lock or install a new or additional lock without furnishing the Association a duplicate key. Pass-keys are kept in a locked box which the Maintenance Manager may use only as authorized by the Board for emergency use.
- Unit owners, lessees, or invited guests shall not admit unknown persons or visitors through any of the doors of the building. All unknown persons and visitors shall be directed to use the Entra-Guard System located at the north and south lobby doors. Owners are listed on the Entra-Guard System. Any name change will require a $25.00 fee.
- LOBBY
- The lobby is a reception area for the arrival and departure of residents or their guests. It is not a recreational room and not for individual unit owner use.
- Only the south lobby door may be used for deliveries or by tradespeople.
- The luggage and grocery carts will be kept in the hall leading from the covered parking at the place designated. They are to be used for the convenience of all occupants and should be returned immediately after use.
- PASSAGEWAYS
- Elevators, lobbies, corridors, and stairways throughout the building shall remain unobstructed at all times. Decoration and the placement of furniture by unit owners is not permitted in these areas.
- The installation of a door bell or door knocker is permitted for each unit.
- ELEVATORS
- Smoking is not permitted in the elevators, lobby areas, stairways or corridors. It is contrary to law and subject to legal penalties per the Florida Clean Air Act.
- All persons using the elevators, corridors, stairways or lobby on the way to or from the beach or swimming pool area must be appropriately attired, in footwear and beach robe or other cover-up and be properly dried.
- When using the elevator for moving furniture, it is the responsibility of the unit owner to make certain that the sidewall padding is used. Padding is available through the Association's Maintenance Manager. All furniture deliveries must be approved by the Association's Maintenance Manager.
- PARKING
- All enclosed parking spaces have been assigned to the unit owners for their respective exclusive use. Temporary use of another unit owner's space may only be done with the approval of the unit owner. Each unit owner will be issued two (2) Island House Southeast parking stickers to be used on resident vehicles and guest vehicles. If unit owners expect additional guests, their guest's automobile registration numbers will be posted on the lobby board.
- The open parking spaces are for guest parking and the use of unit owners and approved tenants.
- Enclosed parking spaces are for passenger cars only. The temporary parking of commercial vehicles by delivery men, tradesmen and service men while engaged in business at the premises is permitted in the outside parking spaces only and only on the south side of the building.
- Vehicles may not be backed into spaces (exhaust fumes damage walls).
- All other types of vehicles such as motorcycles, trailers, recreational vehicles, trucks and boats are prohibited. All exceptions must be approved by the Board of Directors.
- No one shall conduct or permit to be conducted any repairs of any motor vehicles on the property, or allow to be discharged upon the property any grease, gas, oil or other such substance.
- No one shall store or allow to remain on the property any unregistered or inoperable vehicles or any parts thereof
- At all times, cars shall be parked straight, at right angles to, and centered with, the concrete bumper strip in all parking areas.
- DRIVEWAYS
- There shall be no parking at any time in the approach driveways or under the
porte-cochere except for a time limited to that necessary for the loading or unloading of passengers, luggage and hand-carried merchandise. At no time will a vehicle be left unattended in these areas.
- The use of skates or skateboards is prohibited on all condominium property.
- ROOF
- Except in the case of emergency or maintenance, no one shall have access to the roof without first obtaining approval from the Maintenance Manager or the Board of Directors. The roof doors are locked and alarmed. If alarm should sound, directions to call the Management Company are posted and should be followed.
- No radio or television aerials shall be installed on the roof other than by the Association.
- No storage of any materials will be allowed on the roof.
- POOL AND BEACH AREA
- The use of the swimming pool area shall be limited to unit owners, registered tenants and invited guests.
- All parties using the pool shall do so at their own risk and agree to abide by all applicable state laws, municipal ordinances and agency regulations.
- As a condition for the privilege of using the pool, there must be a compliance with the following:
- The pool shall not be used before 8:00 a.m. or after 6:00 p.m.
- The pool shower must be used before entering the pool.
- Beach sand and tar shall be removed from feet and shoes at the top
of the steps at the beach with cleaning materials provided there.
- Appropriate attire shall be worn.
- No diving of any kind.
- Bathing load not to exceed 10 persons at any one time.
- No owner's guest may use the recreational facilities unless the owner is in residence.
- No animals or pets of any kind are allowed in the pool area or on and around the pool deck.
- Food and drink are not allowed in the pool area or on and around the pool
deck.
- Emergency telephone is located in the elevator.
- Unit owners are required to keep the beach area clean. Rubbish containers and products to remove sand and tar are available on the steps to the beach.
- BALCONIES
- Nothing should be swept, shaken, poured or tossed from any of the balconies.
- No hosing of the balconies is permitted, except on Monday of each week between 8:00 a.m. and 10:00 a.m. Hosing is allowed with water only. No soaps, detergents or chemicals should be used on the balconies while hosing.
- No carpet, tile or any other material shall be affixed to the balconies.
- No item of any kind shall be affixed to the walls of the balconies.
- No laundry, bathing suits, towels and the like should be hung on any railing of the balconies.
- No barbecuing is permitted on the balconies or elsewhere on the property.
- DECORATIONS
Holiday decorations are only allowed on unit owner's doors and balconies. Only artificial fire retardant materials may be used. All decorations must be removed by January 7th.
- STORM SHUTTERS
- All unit owner's shutters must be able to be properly secured. Owners who fall to correct shutter problems will cause the Board to exercise its right under Florida Condominium Code, Chapter 718.113 which allows the Board to have the repairs made and forward the bill to the unit owner.
- All new installations of storm shutters must be approved by the Board of Directors and meet Island House Southeast specifications.
- SIGNS
- No signs, advertisements or notices of any kind shall be exhibited, posted or attached to the exterior of the building or any part, inside or outside, of the common areas of the condominium property.
- The sole exception is any sign required by law.
- SMOKING
Smoking is not permitted in the common areas within the building. For the comfort of others, unlit cigars and pipes should not be carried throughout the building.
- NUISANCES
- No unit owner shall make or permit any disturbing noises in the building by himself, his family, servants, employees, agents, visitors, and licensees, nor do or permit anything by such persons that would interfere with the rights, comforts or convenience of other unit owners. For greater clarification, no unit owner shall operate any noise emitting appliance (stereo, radio, vacuums, etc) in the unit between the hours of 11:30 p.m. and the following 7:00 a.m. if it shall disturb or annoy other occupants of the building. No unit owner shall conduct, or permit to be conducted, vocal or instrumental instruction at any time if the same shall disturb or annoy other occupants. No other nuisances shall be allowed upon the condominium property, nor any use or practice that is the source of annoyance to residents or which interferes with the peaceful possession and proper use of the property by its residents.
- The kitchen ventilating system must be used when cooking to prevent odors from permeating the hallways.
- SOLICITATIONS
No trade or commercial solicitations or door to door canvassing are permissible in or about the condominium property.
- STORAGE
No items of furniture, equipment or other property shall be stored in any part of the condominium building, except in the owner's unit and their designated storage room.
- TRASH
- All trash must be bagged or wrapped securely and tied before being placed in the trash container.
- Large cartons must be broken down or cut up into small sections.
- Glass, plastic, newspapers and all recyclables must be deposited in the marked recycle bins.
- TRADESPEOPLE
- No tradespeople are permitted in or about the condominium property before 8:00 a.m. or after 5:00 p.m. The Maintenance Manager must be informed of all tradespeople scheduled to work on the property in writing in advance.
- No tradespeople are permitted in or about the condominium property on Saturdays, Sundays or legal holidays except for emergency purposes.
- All arrangements for use of the elevators, deliveries and transporting of materials by tradespeople shall be made with the Maintenance Manager.
- The unit owner should be present or represented by someone to supervise all workmen and deliveries. In the absence of the unit owner, the Maintenance Manager must be advised.
- No construction materials or tools are allowed in the hallways except while in transit to a unit owner's apartment.
- Deliveries and tradespeople shall exit and enter only through the south door of the building and never through the front lobby.
- The unit owner shall be responsible for the removal of all surplus materials from the premises and the clean-up of common areas adjacent to the apartment and elevator areas.
- The unit owner shall be liable for damage to the condominium property caused by deliveries, moving, maintenance or transportation of property.
- Only tradespeople who have met insurance requirements shall be allowed to work in the owner's units. Otherwise, the unit owner shall be responsible to indemnify, defend and hold the Association and other unit owners harmless against any loss caused by the work.
- ASSOCIATION PERSONNEL
- A unit owner shall not personally engage any maintenance personnel or agents of any Management Company hired by the Association to perform any work or services for the unit owner during that employee's normal working hours.
- No employees of the Association, its agents or employees, or agents of any Management Company hired by the Association, shall be sent off the condominium property by any owner at any time for any purpose during that employee's normal working hours.
- GUESTS
- If house guests are permitted to occupy an apartment in the absence of the unit owner, the Board must be so notified in writing prior to the expected arrival date, with advice as to the period of authorized occupancy. Notice will also be posted on the bulletin board by the elevator.
- If members of an owner's family are to have unlimited visiting and occupancy privileges, the Board of Directors shall be so advised in writing.
- Owners, lessees or house guests shall not invite others to use the recreational
facilities of the Association unless the owner or lessee is in residence.
- PETS
- Unit owners may not keep any pets on the premises at any time.
- Tenants or lessees are not permitted to keep any pets on the premises.
- SALE AND LEASING OF UNITS
- To aid the Board of Directors in determining whether or not it should approve or disapprove prospective purchasers and tenants, as contemplated by the Declaration of Condominium, the Board of Directors shall prepare uniform application forms which are from the Management Company. These application forms are intended to elicit information essential to the exercise of a reasoned
judgment.
- An application form shall be executed by the prospective Lessee, which form shall contain a provision to the effect that the unit owner has made the Association Rules and Regulations available to the applicant and that the applicant is familiar with the provisions thereof, agrees to be bound thereby, and will comply with the terms of all documents governing the use and occupancy of the condominium property.
- After approval by the Association, entire dwelling units may be rented, provided the occupancy is only by the Lessee and his family, servants and guests.
- No guest will be permitted to occupy a leased unit in the absence of the tenant.
- No rooms may be rented and no transient tenants may be accommodated.
- No tenant shall be permitted to sublease said unit.
- No unit shall be leased more than twice in a calendar year with each rental being for a minimum period of thirty (30) days. Within the meaning and intent of this provision, the use and occupancy of a unit in the absence of the owner, by any other party other than a member of the owner's immediate family, shall be deemed a lease of the premises.
- No signs are permitted on, in or about the Condominium indicating sales or leases.
- The Board of Directors must be notified in advance and approve any "Open Houses" to be held.
- The unit owners and their agent shall act in a responsible manner so as to preserve the security of the building.
- A $100.00 administrative fee for Lease Agreements will be charged and a $1,000.00 Security Deposit is required to be held by the association until the termination of the lease.
- MAINTENANCE BILLS
- Maintenance bills shall be payable quarterly.
- Maintenance bills shall be sent one month prior to the commencement of each
quarter.
- Interest at the rate of 1 1/2% per month (18% per annum) shall be added to each bill retroactive to the first day of the quarter, if maintenance payments are not made within thirty (30) days following the first day of the month of each quarter.
- GENERAL
- No unit Owner shall permit any use of their unit that allows a fire hazzard to exist nor shall any use be made of common areas that will increase the insurance costs of the common property.
- A Bulletin Board is maintained next to the elevator and is to be used only for approved Board of Directors' notices.
COMPLIANCE
- The Board of Directors shall have such power of enforcement as might be reasonable and practical to assure compliance with all rules, regulations and restrictions of the Association including the ability to impose reasonable fines for violators of these rules and regulations. The Board of Directors shall impose upon unit owners a fine of $50.00 per occurrence for violation of these rules and regulations, not to exceed an aggregate of $1,000.00 for each continuing occurrence. No fine will be levied until the unit owner has been given notice of the violation and an opportunity to be heard by the Board of Directors or a committee appointed by the Board of that purpose. The Board of Directors' decision shall be final. Any unpaid fine shall be subject to an interest fee of 18% per annum (1 1/2% per month).
- The Rules and Regulations of the Association may be amended or supplemented from time to time by the Board of Directors provided, however, that written notice thereof shall be mailed by regular mail or hand delivered to each unit owner within fourteen (14) days after adoption.
