FIRST AMENDMENT TO

THE DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS

FOR CHARLESTON COURT AT ABACOA

THIS FIRST AMENDMENT to the Declaration of Covenants, Conditions, and Restrictions for Charleston Court at Abacoa is made this___ day of __________, 1999 by ABACOA HOMES, INC., a Florida corporation ("Developer").

RECITALS

WHEREAS, the Developer and the CHARLESTON COURT AT ABACOA HOMEOWNERS ASSOCIATION, INC., a Florida corporation not-for-profit, ("Association") have recorded in Official Record Book 10775, commencing at Page 1132, of the public records of Palm Beach County, Florida, the original Declaration of Covenants, Conditions, and Restrictions for Charleston Court at Abacoa, ("Declaration"), and

WHEREAS, the Developer retained in Article II of the Declaration the right to submit additional property to the Declaration by recording an amendment to the Declaration, and

WHEREAS, the Developer desires to subject the additional property to use restrictions and maintenance requirements not previously stated, and

NOW THEREFORE, the Developer with the consent and joinder of the Association, does hereby make the following amendment to the Declaration of Covenants and Restrictions for Charleston Court at Abacoa Homeowners Association, Inc.:

  1. The property described below is hereby submitted to the Declaration:

    All of the plat of CHARLESTON COURT AT ABACOA PHASE II according to the plat thereof recorded in Plat Book_____ Pages_______, Public Records of Palm Beach County, Florida

  2. This amendment will be binding on all persons, their heirs, successors, and assigns having any right, title, or interest in or to the property hereby submitted to the Declaration, or which may be submitted to the Declaration, and shall inure to the benefit of each Owner.

  3. All terms, conditions, covenants, restrictions, and provisions of the Declaration, which are not hereby modified shall be and remain in full force and effect.
